Terms of Service

1. Acceptance of Terms

By accessing or using the GrowthTitan platform (the "Platform," "Titan," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

2. The Platform and Services

GrowthTitan operates the Titan growth platform (SaaS) for home services businesses, integrating with ServiceTitan and ad platforms to deliver AI-driven marketing intelligence, aggregator management, and revenue attribution. Features, functionality, and pricing may change from time to time.

3. Accounts

You must be at least 18 years old and authorized to bind your business to create an account. You are responsible for all activity under your account. Notify us immediately at legal@growthtitan.ai if you suspect unauthorized access.

4. Subscription and Billing

  • Titan is billed monthly in advance. Current pricing is published at growthtitan.ai/Pricing.
  • Subscriptions auto-renew each billing cycle until canceled.
  • Refunds are handled case by case; partial-month refunds are not typically issued.
  • Late or failed payments may result in suspension after reasonable notice.

5. Acceptable Use

You agree not to:

  • Use the Platform for unlawful, abusive, or harmful purposes.
  • Reverse engineer, copy, or resell the Platform or its output.
  • Attempt to gain unauthorized access to our systems, other accounts, or connected third-party platforms.
  • Use the Platform to send spam, unsolicited communications, or content that violates any third-party platform's terms (ServiceTitan, GoHighLevel, Google, Meta, aggregator networks).

Consent for communications to your customers. You are solely responsible for obtaining and maintaining any consents, permissions, and disclosures required from your own customers before any email, SMS, or other communication is sent to them through or as a result of the Platform — including through platforms you have connected, such as GoHighLevel. This includes consents required under the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and applicable state telemarketing, call-recording, and privacy laws. You are responsible for honoring opt-out and do-not-contact requests promptly, for maintaining your own suppression lists, and for the content of the messages your campaigns send. GrowthTitan provides the tooling; you determine who is contacted and what is said to them.

6. Third-party Platforms

Titan integrates with third-party services including ServiceTitan, GoHighLevel, Google Ads, Google Local Services Ads, Meta Ads, Avoca AI, and lead aggregator networks (Angi, Modernize, Inquirly, eLocal, and others). Your use of those platforms is governed by their own terms. We are not responsible for third-party outages, data loss, or policy changes on their side.

Each integration is connected using an account that belongs to you and is authorized by you through that platform's own OAuth or credential flow — we never ask for your password to a third-party platform. You represent that you have the right to connect each account and to permit GrowthTitan to access and process the data in it. You may revoke any connection at any time, either from within that platform (for GoHighLevel, Settings → Integrations) or by asking us to disconnect it; features that depend on a revoked connection will stop working.

7. Intellectual Property

All Platform code, designs, trademarks, agent configurations, AI prompts, and documentation are the property of GrowthTitan.ai. You retain ownership of your business data, ad accounts, and customer information. We retain only a license to process that data to deliver the Platform.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE SPECIFIC REVENUE, ROAS, OR LEAD OUTCOMES.

10. Limitation of Liability

To the maximum extent permitted by law, GrowthTitan's aggregate liability for any claim arising out of or related to these Terms or the Platform will not exceed the fees you paid in the twelve months before the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

11. Termination

You may cancel your subscription at any time from your account settings. We may suspend or terminate accounts that violate these Terms or that pose security or legal risk. On termination, we will delete or return your data per our Privacy Policy retention rules.

12. Governing Law

These Terms are governed by the laws of the State of Ohio, USA, without regard to its conflict of law provisions. Any dispute will be resolved in the state or federal courts located in Ohio.

13. Changes to these Terms

We may update these Terms. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance.
